With the recent announcement by Kathleen Sebelius, Director of the Department of Health and Human Service that Catholic Churches and other Christian organizations must provide health care that includes contraception, the issues arise as to where such power is derived. The Declaration of Independence and the Constitution have long been seen as legal protections against violations of fundamental rights. The Obama Administration has declared that conception is a fundamental right, a right, in the case, which places it at odds with the fundamental right of conscience protected by the Free Exercise Clause of the Bill of Rights. Conservatives have argued that requiring contraception in church provided health care is a violation of “conscience.” Listen is as Host John Snyder, Steve Z.
